{"id":2896,"date":"2020-11-13T14:43:25","date_gmt":"2020-11-13T14:43:25","guid":{"rendered":"https:\/\/peoriamag.com\/?p=2896"},"modified":"2020-12-14T14:44:11","modified_gmt":"2020-12-14T14:44:11","slug":"senate-passes-bill-requiring-legislative-approval-of-dhhs-emergency-orders-beyond-28-days","status":"publish","type":"post","link":"https:\/\/peoriamag.com\/?p=2896","title":{"rendered":"Senate passes bill requiring legislative approval of DHHS emergency orders beyond 28 days"},"content":{"rendered":"<div class=\"article__section article__section_type_text utility__text\">\n<p>\u00a0Legislation approved by the Senate on Thursday would limit emergency orders issued by the state Department of Health and Human Services (DHHS) to 28 days and require that any extension of such orders receive legislative approval before taking effect.<\/p>\n<\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>A press release outlined\u00a0Senate Bill 1253 that would reform the state health code to stipulate that DHHS emergency health orders would only be valid for either the time indicated in the order or 28 days, whichever is less.<\/p>\n<\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>After 28 days, such orders would be invalid unless a request from the department director to extend an order for a specified period is approved by resolution of both the Senate and House of Representatives.<\/p>\n<\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>\u201cUnelected and unaccountable DHHS bureaucrats should not be able to issue freedom-restricting emergency orders that disrupt lives and threaten livelihoods in perpetuity,\u201d said bill sponsor\u00a0Sen. Lana Theis, R-Brighton. \u201cThe state Supreme Court made it clear that even after declaring an emergency, Gov. Whitmer does not have the right to extend such orders without legislative approval, and neither should her employee, Robert Gordon. My bill will ensure the people have a say in the matter, and I urge my colleagues\u2019 and the governor\u2019s support.\u201d<\/p>\n<\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>If signed into law, the bill would have an effective date of Nov. 15, 2020.<\/p>\n<\/div>\n<div class=\"article__section article__section_type_text utility__text\">\n<p>The bill now advances to the state House of Representatives for consideration.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"\u00a0Legislation approved by the Senate on Thursday would limit emergency orders issued by the state Department of Health&hellip;\n","protected":false},"author":1,"featured_media":2897,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[9],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v15.4 -
